    Wisconsin court praises drunken concert goer

    MADISON, Wis. – An Illinois teen knew he was too drunk to drive home after a Dave Matthews Band concert south of Milwaukee. So he fell asleep in his car, only to be awoken by a state trooper. Travis Peterson, 19, of Dixon, Ill., said even though he told the officer he was drunk and sleeping it off, the trooper ordered him to leave because the lot was being cleared.

    Once out of the parking lot, Peterson was arrested for drunken driving. He was subsequently found guilty and ordered to spend 60 days in jail.

    A Wisconsin appeals court on Wednesday commended Peterson for doing the right thing by trying to sleep it off, and said the trial court was wrong not to let him argue that police had entrapped him.

    The state had argued successfully at trial that people who choose to drink too much can't argue they've been entrapped when stopped for drunken driving. The 2nd District Court of Appeals disagreed......

    This is screwed up I still say this is entrapment.

    I agree, this is entrapment.
    The driver made a good decision not to drive.
    I guess I am not as familiar with WI laws, but when I was a police officer, we were liable if we instructed an intoxicated person to drive.
    That was one of the reasons that we never had them pull the car off the road if we thought they were drunk.
    Either they gave us permission to move it, or we towed it...

    But I wonder at the 60 days in jail sentence.
    Is there more to this case then is being told?
    That seems REALLY high.

    I am guessing that the officer that told him to move and the officer that arrested him are two different people.
    So it isn't necessarily the cops being asses (although I wouldn't rule it out either), but it is definitely an example of the officers showing poor judgment, and the courts not doing their job correctly IMHO.

    Even if they'd have given him a pass on the dui, they certainly could have gotten him for underage drinking.
    He could have pushed the car our of the lot, and next to the curb. If there's a meter, pay it.


    Then there's the lesser important points.
    1. How did he get the alcohol?
    If he had someone 21, buy it for him at the concert, why not get a ride home with him?
    2. Was he alone, or was he with friends?
    They just let him go back to his car, and would have let him drive?

    I don't think in this case involving DUI, it's entrapment. DUI is a serious offense, and should be dealt with, as such.

    I have heard of this happening before. I don't believe it is an unusual incident around here.
    What takes a quarterback to the next level is not arm strength or mobility or any of that stuff. Its the ability to play on critical downs. Manage third downs, or red zones or four-minute or two-minute situations"
