    Whats funny is, with a good smart lawyer, he may just get away with it.....
    They will plead that it's impossible to live with that .4??
    and that since thats a fact, the machine wasn't calibrated right, so they can't prove the real number....He was just tired and some friend had thrown some booze on him...

    my other question is how the hell did the guy start the car with almost a .5? Something just doesnt seem right here, i dont believe someone can live, let alone drive with a .5

    Unless it was a hospital drawn blood test, lots could have gone wrong......First thing wrong was the guy got behind the wheel drunk.... :

    I got a minor consumption charge when I was 19 with a .47. The only reason I didn't have to go to detox is that I could speak pretty well and passed a couple tests. Then the cop misspelled my name on the ticket and I got off.

    They article says they checked his blood alcohol level twice.
    They must've seen the original reading and did it again, not believing it.

    .336 on my bday 2 years ago started drinking at 7 am
    finished at 230 am and walked home....cop stoped me on my way
    home only way i now it was that high he made
    me blow
    and then gave me a ride home instea dof detox cause i was 3 blocks from home
