    It is murder (3 counts) because when he was previously picked up on DUI charges, he agreed at that time that if he ever killed someone while driving drunk, he could be charged with murder. Apparently, he either thought he could control the drinking, or thought he wouldn't get in a vehicle again while drunk. Now his life is over, as well it should be.

    I understand what you are trying to say but drunk driving is still an accident, it is not like he tried to kill them on purpose.
    Drunk driving is one of the dumbest things you can do, it puts you as well as everyone else at risk, but to say that he is on the same level as a homicidal murderer is pushing it.
    He is not going out there thinking, I want to go and kill someone.
    He should suffer serious consequences, but it was still an accident, a huge mistake of judgement.
    I would never say he meant to do it on purpose though.


    The reason why he would get murder charges is because of his pervious agreements after being previously arrested on similar counts.

    In light of my previous post, I'd also like to say that any time you take someone's life away it is still murder, but it was accidental.

    He might not be thinking he wants to kill someone.

    But he was also not thinking he didn't want to kill someone.

    Like someone said, the act of driving drunk is on purpose. Any damage caused after that point is your fault and not in any way an accident.

    In California, if you drive under the influence, and have an accident in which some dies, you are charged with vehicular homicide.

    Agreed 100%.
    But I still do not classify that as murder.
    The dictionary says murder is when you "kill intentionally and with premeditation".
    This was an accident in regards to murder.
    Therefore it was manslaughter but he is being charged with murder because of prior charges and agreements.
    In other cases, this would have been vehicular manslaughter.
    Not murder.
    It is an accident in regards to it being "murder".

    Drunk driving is getting ridiculous though.
    Over the past few months, I lost two of my best friends from HS due to it.
    I love drinking and getting a bit messed up, but when I am, I realize that I CANNOT DRIVE.
    You shouldnt be drinking if you can't stop yourself from driving.
    Drunk driving is a selfish act.
    I don't care if you don't care about your own safety, but when you are interfering with the safety of others who have no say in the matter, that is where you cross the line.
    This is precisely why drugs are illegal as well.
    The gov't really doesn't care as much about what you do with yourself, it is the risk that you put others who do not authorize that act that causes the problems.
    Don't be selfish, don't drink and drive.
    Instead of driving when your drunk, have a candy cigarette and sober up while you enjoy it.
    Then you can drive home when you ensure the safety of others and yourself.

    OK, thank you Mike.

    And to anyone saying it is murder outside of the special circumstances Mike just explained, it is not. Murder has a mens rea requirement of intent to kill, malice aforethought. He intended to drive drunk, albeit an impaired decision. But he did not intend to kill these people.
