Man dying of cancer wins lottery — with a catch

Given a year to live, N.Y. resident fighting to get lump sum to pay for care

    http://www.msnbc.msn.com/id/17122169/

hopefully they can work something out. I am a little mixed about this one. HE has lung cancer from years of smoking so part of me says his health is his own problem and he shouldn't get speciel treatment. but at the same time if he cvan get treatment to extend his life he should be allowed to do so.

That's the one thing I dislike about about the US lotteries, if some wins the lottery then it should be paid out in full there and then. This 'lottery' of whether you live long enough to collect the full amount is wrong IMHO.
I agree his lung cancer is self-inflicted but he should be able to have the full amount so that he can use as best suits him.

    Kind of ironic.

Lifes a bitch I suppose, maybe they can get the rules changed in time for the guy.

A lot of the other lotteries such as PowerBall give it in lumps sump, I think they all should.
I hope they give the guy his money.

It may be "self-inflicted", but its not like he broke the law in doing it.
I say give the guy his money!

He didn't win 1 million dollars.
What he won was 50,000 every year for 20 years.
There are places that will give you a lump sum if you will sign the payout over to them.
Its usually about a third of the total winnings.
It seems to me he should be able to sign the payout over to the treatment center he wants to go to.

    Lottery 'sympathetic' but 'not able'
"We're incredibly sympathetic," said Susan Miller, deputy director of the New York Lottery. "But we're not able, because of our rules and regulations, to just write him a (lump-sum) check. We're absolutely willing to expedite the paperwork if he can talk to a bank or a company that does this."

Schenk also has turned for help to his state assemblyman, Joseph Errigo, who is considering pushing a bill to allow the lottery to award a lump sum in extraordinary cases. But legislation in Albany often take a year or longer to take effect — possibly too long for Schenk to benefit.

I'm assuming it is illegal to pay him a lump sum so he is SOL.

Here in CA you can take a lump sum but it is only about 50% of the actual prize.
Then the govt takes its tax bite out of it so you basically end up with about 1/3 of the actual prize.
I think that is the way it is with all lump sum options in the lotteries.
