This seems to be a test of ability to read the question s-l-o-w-l-y before answering.

e.g.
The California marriage law question presented a curve ball about 'California', whereas it focused on the ability to see that 'you' were dead.

In my job, I write a lot, and have to consider the audiences' ability to understand what I write.
But, despite trying to write clearly, there will always be questions about what I wrote.
Usually, it is a result of someone NOT taking time to read and understand.
Some people will misunderstand a word or two that is important, and they will jfmitb when they esvdwlg and yrfhifplrvs.
But they think they know what I wrote and say I was unclear.

Worst part is I took that same test a long time ago and got the same two wrong that time too.
