    If you haven't trained your dog not to scamper for freedom the first chance they get, it's your fault if it jets out and gets killed. My dogs were trained and wouldn't do that. They should have to pay for damage to the car.

    Now Ely is suing the Munthes for about $1,100 for damage to his car, time he had to take off from his two jobs to get the car repaired, and court fees.
    The Munthes have filed a $2,400 countersuit against Ely for the cost to buy Fester, the time they had to take off work for court appearances, and the cost of buying a dog to replace Fester.
    Sounds to me like they are both being idiots about it.
    First, the family that owned the dog has absolutely no leg to stand on in court.
    They cannot possible sue the driver because their dog ran out into a public street and was hit by a car.
    That is unbelievably asinine.

    Second, the driver is in the right for suing the family for damages, but he is being an idiot about it.
    I feel bad for their loss, but it is their fault that the dog got out.
    However, I don't think that time off from work and court fees are applicable in this case.
    I expect him to get just what it cost to repair the car, no more.
