Don't ask me...I don't do criminal law!!! But for what it's worth, tark's surmised explanation is most likely the correct one.
You will have to talk to the resident attorney Cajun to be sure but I think it means that he received a 364 day sentence and he doesn't have to serve it in jail as long as he doesn't have any probation violations. If he breaks any rules set down by the court he will go before a judge and he could spend whatever time is left of his term in the clink!!
