You can't keep employees that potentially are losing you money, JMHO.
You have to fill that roster spot with someone who can perform and is reliable. The hiring and firing and suspending seems like it might be a team issue rather than a league issue.
If the NFL teaches guys what they expect and have a set action for specific misconduct, then I can see the league getting away with this and see it as being above the team by team issue.
If Goodell is doing his decision making on a case by case basis then he is putting his judgment up for questioning.
If they can prove that it is the conduct and not the alcohol, will that be enough for the NFL to win this case.
The Tarpley precedent is a ? mark.
If they reinstate them that is all they have to do, teams then would have the choice not to hire them. It really didn't explain the key issues of the Tarply case that well...
Because the league kept testing him, that meant they were responsible for letting him back in and they unfairly held him out even though he was rehabbed.

I think that the NFL would have sat down after the Tarply case and look at there rule and how it compared to the NBA policy and they would have made changes to make sure they wouldn't get caught with their pants down too.

I thought that the league's substance abuse policy was immune to this type of lawsuit due to the fact that it negotiated with, and agreed to by, the union that represents the players.
