How could a nightclub be dumb enough to use a pro athletes name without permission?

Yeah, that was a pretty dumb move on the part of the night club.
According to SI, they had been doing it since 2006 during their Friday Night Lights parties.
Looking at the entries for Avalon on clubplanet, my guess is that it was a DJ/VJ who used T.O. or something as a stage name.
He may have even dressed up in a Cowboys jersey or something like that.
Still pretty dumb on the part of the club.Zeus wrote:

How about a "C&D" letter first?
The moron is just trying to get his name in the papers again, and at the same time market a potential new business for himself.
Granted, the nightclub should know better, but T.O. is being a bit greedy here.

I hate TO just as much as the next guy, but you can't blame him for being upset about this.
The nightclub knew what they were doing was wrong, so I don't think TO has to be real "fair" with them.
You may be onto something though with the publicity bit...he has been out of the spotlight for awhile now.
